City treasurer resigns over lack of job description and frustration

After not having a treasurer for nearly six years, recently elected city treasurer JoAn Churchill submitted her resignation after being in office 77 days. On Monday, March 18 she handed her letter of resignation and keys to Mayor Michelle Hobbs. She also E-mailed it to department heads and the news media. Churchill was elected treasurer in November, 2012 after serving nearly two years as bookkeeper.

In her resignation she stated, "Because of the situation in the City of Alexander, the extreme ‘brokenness’ of the governing body, because there is no ordinance describing my duties and finally no apparent common ground to pass such an instrument, I hereby tender my resignation effective 2:00 PM, 3/18/2013."
After her resignation Police Chief Horace Walters stated to the news media he's been investigating the financing of the police fund and says revenue that should be going into it isn't being deposited. He told Channel 7 about $6,000 is missing, then later told the Arkansas Democrat-Gazette nearly $12,000 has not been deposited into the police department's account. Walters told the Democrat-Gazette the investigation is continuing.

Churchill says she was unaware of this most recent investigation mentioned by Walters. But she added, "they have been saying they are investigating me as long as I have been here."

This isn't the first time Walters has made such a claim. He made a similar allegation in 2011, while Paul Mitchell was mayor. He claimed about $10,000 was missing from city funds.

The Arkansas Division of Legislative Audit (ADLA) was already conducting its annual audit of the city's 2010 finances and procedures. Walters asked them to look into the alleged missing $10,000. The ADLA didn't find any missing funds. CORRECTION: There's been no official report by the ADLA on the alleged missing $10,000. There is no mention of it or the special audit request in the 2010 report on Alexander's finances for that year. However, there's also been no report of missing funds being discovered. To our knowledge no charges have been filed and there's been no arrests.

Churchill says it's not a question of mishandled funds, it's a lack of funds.

"It isn't my job to make sure there is enough to pay all the bills," Churchill said. "My job was to post; disburse; report - period."

The police department has three regular sources of funding; a Bond and Fine Account, a 5/8-cent sales tax and the General Fund. Churchill says the city's district court was closed during most of 2012, which greatly reduced the 85-percent the police department receives from the Bond and Fine Account. Churchill says she only remembers court being held twice after June.

Under state law bond and fine revenue is divided 85-percent to the police department and 15-percent to the city's general fund.

The department's 5/8-cent sales tax was part of a tax referendum passed by voters before the Woodland Hills annexation in 2006. The referendum earmarked 5/8-cent to the police department, 2/8-cent to the park and 1/8-cent to the fire department. The fire department also receives another 1-cent sales tax from a previous referendum. Those funds are dedicated by referendum and cannot be used by the general fund. The general fund does not have a dedicated sales tax of its own.

The lack of revenue was causing the police department and city hall to get behind in paying bills. Churchill says the council voted to use a portion of the monthly franchise fees, paid to the city, to get the police department caught up on its overdue bills.

ADLA auditors are currently auditing the city's 2011 finances. Churchill says she has requested the ADLA conduct an audit of the alleged missing funds.

The City of Alexander hadn't had a treasurer for about six years when Churchill was sworn in January 1, 2013. She was elected in November, 2012. It was thought this ended the city's use of a bookkeeper in place of having an elected treasurer.

In 2002 an ordinance was passed changing the position of “recorder-treasurer” into “recorder” and “bookkeeper” eliminating the elected position of treasurer. According to the minutes of a special meeting held four years later on April 24, 2006, the council "voted to change Michelle's title to recorder only."

This second move was done without the aid of an ordinance. All of this occurred while Shirley Johnson was mayor and before the annexation of Woodland Hills later in 2006. Michelle Kidd, now Hobbs, was recorder.

In 2010 the Arkansas Division of Legislative Audit was conducting its annual audit of the city's accounts for 2009. During a 2010 council meeting Mayor Johnson reported the auditors discovered the city didn’t have a treasurer and said a treasurer is required and the vacancy needed to be filled.

There was a split-decision over the legality of the 2002 ordinance. According to the minutes of the November 15, 2010 council meeting, Mayor Johnson stated she had spoken with Don Zimmerman, the head of the Arkansas Municipal League (AML), about the recorder-treasurer position and the 2002 ordinance.

"He said that even though the city council in the past had separated the two, because it was not sent to the election commission as such, then it remains one office, so Michelle Kidd is the recorder-treasurer already," Johnson says in the minutes.

Paul Mitchell, then alderman, said there seemed to be a conflict of opinions. He sent documents to AML Attorney Mark Hayes who said the 2002 ordinance could be interpreted as an attempt to separate the positions of recorder and treasurer even though the word bookkeeper is used.

In 2008 Hobbs, Michelle Kidd then, ran for re-election unopposed to a four-year term as recorder.

At a later council meeting in 2010, after consulting with the AML, the council passed a motion declaring the treasurer's position vacant and asked Mayor Johnson to advertise for resumes and set a meeting date so the council can interview the applicants. Information about the vacancy, job requirements and a request to submit an application with a resume was posted throughout the city. Applications were received, but they were never presented to the council.

In 2010 city bookkeeper Jeri Rainey had left for health reasons. Hobbs stepped in as treasurer/bookkeeper.

Johnson increased Hobbs's salary $250 per month to serve as treasurer/bookkeeper. She was already receiving $200 per month as recorder. Hobbs, then and now, works for the state full time.

Johnson was defeated in her attempt at re-election in November, 2010 by Paul Mitchell. Her 20 years as mayor ended December 31, 2010. Michelle Kidd-Hobbs also ran for mayor in 2010.

On January 1, 2011 Mitchell, along with some new and current aldermen, were sworn in. At a special meeting on January 31, 2011 Mayor Mitchell gave a brief history for the new members of the City Council as to why the City of Alexander does not have a treasurer.

Along with accompanying documents, Mitchell explained to the new council members about the 2002 ordinance. He also filled them in about his most recent discussion with Mark Hayes of the AML.

According to the minutes of the January 31 council meeting, Hayes told Mitchell, "the 2002 ordinance is valid and the city needed to stop paying Michelle Kidd as treasurer."

The council voted to stop paying Kidd the $250 as treasurer. She remained recorder and continued to receive $200 per month for that position.

Churchill was appointed bookkeeper at $9 per hour, working a 40 hour week. That's about $1,560 per month.

In the November, 2012 election Mitchell lost a re-call vote and JoAn Churchill was elected treasurer. Seven of the eight aldermen either lost re-election or didn't run. Farren Wadley ran unopposed.

In mid-November Mitchell resigned and in December out-going council members made Michelle Hobbs mayor. Alderman Harvey Howard opposed the appointment and voted "no."

With Hobbs as mayor that same council also declared the treasurer's position part-time and set a monthly salary of $500. Nothing was done about the bookkeeper position.

In a 4 to 3 vote the current council in February approved hiring PayChex to handle payroll accounting and the printing and signing of payroll checks. But, nothing has been decided about who will perform the other accounting duties.

  1. Good for the City of Alexander that the X-Treasurer is an X. The "MOUTH PIECE" behind her needs to be an X. The X-Treasurer could not do her job unless Juanita told her it was OK to pay bills. The City could have a little more money if the X-Treasurer would have paid bills on time avoiding late fees and disconnect charges. She even paid excessive COMP. TIME to part time employees who don't qualify for COMP. TIME. One of these employees was her PREGNANT relative who the X-Mayor hired. The $10,000 the Chief was talking about WAS NOT posted in the POLICE FUND. She was trying along with "BIG MOUTH" Juanita to make the Chief look bad. This has probably happened again if the figures could be found in the X-Treasurer's accounting. Hard to make heads or tails out of what she has done in the past year. The ADLA did not find any missing money it was just put (Mistakenly of course) in the wrong account. This is Tax money and she needed to do her job correctly.
    It is not a LACK of funds because the CITY SALES TAX REFUND was $46,012.10 for Feb 2013. It was up $2,018.99 on sales of $2,300,605.00 for Feb. 2013. X-Treasurer Churchill said "It isn't my job to make sure there is enough to pay the bills but my job was to post; disburse; report----PERIOD!!!!. As far as I know the Council has never got an accurate account of City funds in each accout. It was for sure not posted properly. Residents have tried FOI request and she has not complied. By LAW the year end 2012 FINANCIALS should have been published in a newspaper but SHE neglected her job and did not do it. Maybe "BIG MOUTH" Juanita told her not to publish it. The X-Treasurer can QUOTE how the SALES TAX money should be divided but SHE did not do it correctly. If the 4 EXISTING COUNCIL would have attended the Feb. monthly meeting maybe a company could have been hired to do the accounting duties. But NO they have decided that the 4 want to run the City the way they want to instead of doing the right things.

It would be logical to try to find answers, find common ground, take steps forward, even if it were baby steps, but all you or I see is, GOSSIP, BACK-STABBING, HATE SPEECH, STUPID REMARKS, LIES, NEGATIVE CASE BUILDING, it looks and sounds like a second grade play ground fighting over who is IT.

    3. Boy O'boy! Sounds like someone has an attitude when it comes to Juanita & others. Hummm, CLEARLY, you have no clue. If you know so much, then Why didn't you run for the treasurer position. Where were you at all the meetings? Never heard you get up in person and DARE to speak to the community about such things as you have here. If the PUBLIC REALLY KNEW......how things were done there, by certain individuals,Well they would be really ashamed to live in such a city or be part of the problem and be proud of what they have created. Misery loves company. It's not about what is best for the community any more...because those who were there to better the community have been bullied, disrespected, pushed around, talked down to, set up, till they have no other choice but to leave. I KNOW Ms Churchill personally and think she has on MANY occasions gone way above & beyond what one person should trying to do what was right for the city of Alexander.

    4. I do have alot of CLUES as to what is going on. I have attended the Council Meetings. Those properly held but not those illegial ones. The TV and press all have CLUES to what the truth is with the CITY. Just like when "LOUD MOUTH" Junita and the other 2 "MEEK SHEEP" that follow her got up and walked out of a Council Meeting because SHE didn't like what was going on and being said. The"LOUD MOUTH" even stopped before she walked out and ask Councilman Chapman "Aren't You Comming with us?" He stayed and felt it was his sworn duty to stay for the purpose of doing City business. I would have hated to be him later that night or the next day when the rath of the "BIG MOUTH" came down on him. Seemed to have worked for her though because he did not attend the last regular meeting along with the other "MEEK SHEEP".
      I WOULD ASK FOR "ALL 4 REMAINING COUNCIL MEMBERS (Deciples) TO STOP THEIR ATTEMPTS TO RUN THE CITY OF ALEXANDER BY THEMSELVES WITH THEIR SEPERATE AGENDA AND DO WHAT THEY WERE ELECTED AND SWORE TO DO. SIT DOWN AT REGULAR MEETINGS AND DISCUSS OPENLY THE NEEDS OF THE CITY FOR A BETTER FUTURE FOR ALL. You could each get on the agenda and discuss what you think is best for the City instead of having secret meetings.The Citizens could then have some input into what was going on in public comment or
      during an open orderly conversation and don't get up and walk out when things are not going as you 4 would like. DO WHAT YOU 4 WERE ELECTED TO DO!!!!

    6. Point being - they are the ELECTED. Come on, city come out and support your elected officials. Responsibility doesn't end at the ballot box. ESPECIALLY when your in a shark tank. Let them know you are behind them. Voice your opinion in council - they can't arrest all of you! If they try - go for it - it IS A PUBLIC MEETING.
      While some order is required, it isn't a gestopo-state (yet.)

  2. I think the part of the CITY that was annexed in 2006 should DE-ANNEX from the City of ALEXANDER. We the citizens can accomplish that with a PETITION and File it under a VOTER INITIATED ACT when the 2014 ELECTION is held!

    3. If we do de-annex what will we do for a Fire Dept., Fire Trucks and Bldgs. The City has "HOCKED" everything.
      The City does not have the funds to pay off the LOAN.
      We would loose everything. The 4 Council members from the newly annexed area SHOULD do the JOB that they SWORE before God to do and represent the people who elected them
      and not work on some hidden agenda. Every body in City Government needs to come together to make the City prosper, clean up "BURNED OUT, JUNK FILLED, TRASHEY places. JUNKED UP TRASHY PLACES breeds CRIME. Every Citizen needs to take pride in their homes and property.
      All the JUNK VEHICALS could be sold for parts or scrap.
      Call U-PULL IT or the JUNK DEALERS. The money received could help pay for hauling off other trash to the landfill. The old appliances and tires could be recycled at NO COST. The X-MAYOR put a hold on the CLEAN-UP because probably some of the places were "DOPE HEADS" that his wife used for her supply. He did not want to make them MAD!!! Now the 4 Council members are following in his steps and trying to put the X-Mayor in as a Council Member. SOME AGENDA they have to improve the CITY.

    4. Dan Church has one junkie place on the hill. His live in "significant other" has a Son who has a "JUNK YARD" on SOUTH ALEXANDER ROAD in the City limits in a residential area.He has lots of JUNK TIRES stacked behind one Bldg. (out of site) on the property He has been to Court but the X-Mayor put a stop to the clean up. Why don't he Alderman Church help him clean it up. The "Son" moved most of it from Alderman Church"s property on Mtn. Drive.

    6. If it can. But the City comes first. The only law is that all Fire Departments have to sign a MUTUAL AID agreement.
      If the newly annexed area does not have a Fire Dept. How can it get 833 money or sign a mutual aid agreement? We have already paid for our fire trucks, Stations, equipment and an Ambulance (That the new Fire Chief Sold). So what will we have to fight a fire and save lives with rescue We will be right back in early 1970. If the loan on all our HOCKED bldgs, trucks, equipment and vehicles is not paid everything will be auctioned off. The old City will not have enough tax money to make payments. The newly annexed part cannot buy it back because we gave the Old City all our CASH money we had accumulated over the years with the
      $40.00 per lot on yearly County Land Taxes. The Old City Fathers used it to pay off some old bills.

  5. I attended the Church in the Old city Hall a couple of times. I saw several persons who held office or worked at cit Hall there. the Pastor spoke to Mr Wadley about moving his business in the church.
    I went to JoAn Churchill to ask how Mr. Wadley could have his business in there. Joan told me the church was renting the building, and Farren as a church member would be eummien to any charges cause he would be covered by the church.
    Mr Wadley did a little teaching from the building, he donated most all the money to the church.
    Joan Churchill and the Pastor became at odds with each other, she left the church sighting conflict of interest. the church moved out, because Mr Wadley was working late he had left his stuff in the building for three more days. In the three day JoAn began to tell people he had his business in the building and got some one excited to call the media and show them around. Some of the still pictures the media used were of the building when Mr. Wadley had first moved in, as the items shown in the picture had been removed from building for a couple of months. ( imagine that)

    The signature on the Ethics Commission complaint was that of JoAn's with another persons name, this was shown to the Ethics Commission. Mr Wadley had asked the Church Pastor to come speak on his behalf before the Ethics Commission and the Pastor told him he didn't want to get involved.
    Mr Wadley presented his witnesses and told commission if they thought he was guilty he would abide by there decision. A man doing what is right. You know what really happened and why he was in the building but do not speak of that. You let a lyre and cheat excite you to the pint of making a full out of your self, chastising a good man. I hope your all proud of yourselves. You didn't mar Mr Wadley repetition locally or abroad cause he knows a very lot of people in and out of the state.

    Mr Wadley has the knowledge to bring Alexander up to be a beautiful Little town. He has ideas and can implement them to make the city grow and be prosperous. Mr Wadley is the best thing to happen to Alexander. If you are lucky he may stick around a few more years. I fill sorry for your lying back stabbing people. And I fill sorry that a good man got caught up in lying cheating sceams.
    Remember what go's around comes around. Seems like were seeing that now.

    1. Sounds like you know what you are talking about. You are printing the "TRUE FACTS" about the X-Treasurer and you need to include "BIG MOUTH" Juanita in this story. The X-Mayor and "BIG MOUTH" were bth in on it to get Mr. Wadley taken off the Council along with Councilman Mullins. Can't figure out why someone wants to spout off Scripture and pretend to be so Religous then "BACK STAB" good people. I hope the X-Treasurer does not get re-hired as City Bookkeeper as I have heard is going to take place by "BIG MOUTH" Juanita and her 3 sheep wagging their tales behind her. Councilman Chapman I know you and the X-Treasurer are good friends and go to Church together but PLEASE!!! see the light at the end of the tunnel "IT IS AN ON COMMING TRAIN"

    2. No wonder the city cant get out of the whole it is in, Put her back in what a trick. One of the problems you have city workers thinking they are running the place. If they would just do the job they should and keep the dirty little noses out of other things I am sure that it would be a much happier place to live and work.
      A good house cleaning is what is needed. Start with fresh people that care about the the city and have the purpose of getting along and helping the city grow and to change the image that has to be changed. I here all their crap on this side and that. But I didn't hear one idea of a way to clean up the image. Drugs and uneducated back woods people is all you hear about Alexander.
      At gatherings in larger cities you will here persons laugh about Alexander and say just rednecks what can you expect.
      That is just a shame cause it can all be changed.

    3. For all who are not as blessed as I am, and for those who are – let me tell you about Lou Juanita Wilson (aka – BIG MOUTH) (That’s MS Big Mouth to those who disagree with what is written here.)
      Never, ever has anyone had a true friend, in the mortal flesh like this fine lady. She is respected and revered by her family, her friends who truly get an opportunity to know her, her church family and most of her co-workers (the ones who recognize and value truth.)
      She does not tell KNOW-IT-ALL what to do, instead, even though we know she would advise otherwise, she always says, ‘you do what you feel you have to do.’ She never puts a price on her friendship – like demanding your point of view, or your opinion mimic hers. She is always open for discussion on ideas and values. She isn’t ‘fixed’ in her opinions. She is fair, generous, caring and sensitive. She never judges others on their appearance or lack of it. Her main objective in life is not politics, that is why politicians can pull outlandish behavior and it not be expected and prepared for. Her conversations almost always either are the subject of spiritual things or wind up there. Others I have met through her (i.e. the company she keeps) are her peers. I am honored to be counted a friend by her and those who value the same things she and I do,
      In 74 years I have found few like her. She, as far as I am concerned, stands alone in this town; which is the very reason some are so rude and objecting of her. She is like an alien to them. They have no concept of how she thinks and as a result, reject her.
      Since some reading this only relate to the negative, let me share some of the things she doesn’t do.
      She doesn’t hate any one. She does hate the behavior of negativism. She doesn’t demand you hate that behavior. She doesn’t turn on you if you disagree or happen to have your own opinion. She doesn’t ‘plot’ vengeance against others. She prays for them. She doesn’t back-stab, doesn’t gossip, doesn’t spread untruth, in fact she goes out of her way to shed light on truth. She doesn’t swear, comes close but doesn’t give in to the frustration. She has never said anything about bringing me back as bookkeeper, I resigned, she knows there is no way I would accept the position or the appointment.
      Her husband adores her and depends on her, her children and grandchildren love and respect her. Her true friends value her, and all of us are thankful for her presence in our lives.

    4. Joan you talk about what a good person Juanita is? You say she doesn't speak bad or cause harm and lives a good Christian life? So was it Christian when you and her stood in front of the "Recall Mayor Mitchell" sign. NO! You stood their trying to hide and cover it up cause your two knew it was trouble for your group. The reason you weren't removed from covering it up, because you and Juanita were doing such a good job campaigning for his removal. Voters saw what you did and the voters obviously didn't like it. I just hope I'm not in the same line as you and Juanita are in heaven cause we're going to be there for awhile, cause you too will have a lot of explaining to do.

    5. Actually, it was merely politics. (which I hate, but did indulge in that day.) Truth known, you would have done the same thing. It was no biggy, just politics. Sorry it is such a hurdle to get over.
      My personal take on the recall - I apologized to Paul about it, and we had MANY people who came to the site across the street telling Paul they voted 'for' him. They, to the person, were saddened when they thought they had actually voted for the recall. I believe it would have been a mandate had the wording been different, but that is just my opinion. It is a known fact, for many years, - I saw it in major elections in San Diego, (my home town) the wording is grammatically correct but wrong in the since most people think 'for' is for, some don't read the whole thing, others don't understand it. It nearly always works for the opposition.
      Whoever anon March 26, 2013 at 9:17 PM is, we just don't qualify to tell God how to be God. He'll do His own judging. I know you probably know that, but it is something to think about.
      As for Juanita - you can read about her personal character in Proverbs 31, and her Christian character in Romans 12.
      As far as you are concerned, I'll wager you have good character as well. But our character is influenced by the company we keep, who we listen to, that's where self discipline comes in. My prayer is that God will lead you to those of good character, I'm sure some are, but maybe not all. Any thought negatively based and hate-filled is wrong to me. (Phil. 4:8)
      This is not meant to judge you or anyone else on how you think or the company you keep, or the thoughts you think, we all answer to our own behavior, it is simply meant to reflect on why I feel the way I do, and is only important to me alone.

    Mr Wadley said if you find " I am wrong I will abide by your ruling".
    JoAn Churchill said " I don't want to work for the City of Alexander any more and quite. But as I do I going to call the meda and get coverage cause I'm more important in my eyes. " I don't like the way the City is making changes I will go my own way".

    Our pride gets hurt and it wounds our heats.
    Every one goes through it from time to time. Leaching out at other persons help our pride to fill more important. As some one once told me a long time ago suck it up and keep going.

  10. No Juanita I'm just talking about you. You started this site to tell lies. Save us the trouble, go to the next council meeting and Dan and Jack resign. Your personal agenda won't work. You tried to push your agenda against the council in January. You didn't get your way so like a 4 year old you got up and walked out which was pre-planned. Febuary you showed up and when I mean you (Juanita, Dan, Jack) and tried to argue with the mayor. March you refuse to show up and do you elected job. So will you be there April? Work with the exsiting council and mayor, if not resign and will get someone in who will or wait till election time and be voted out or save us the trouble and not run again

      Now I know one of the X-TREASURER'S problems. She is from CALIFORNIA. I don't understand at all why she don't go back.
      I am glad she is not Catholic because there is not enought time in one day to say enough "HALE MARYS" to get forgiveness for what she has done.
      I hope she can sleep at night with a clear mind. Seems her and NOT "MRS BIG MOUTH" but "MS.BIGBUTT & MOUTH are together most every day trying to run the City.

    2. For the life of me, I recall seeing election results electing Juanita, Dan, Jack, Lonny, Ceola, Brad and unopposed Wadley. Unless you are one of these, (I bet you are not, maybe Wadley) I kind of think you are one of the rejected ones. Regardless, that election voted these people in for what ever reasons, they didn't vote the mayor in, they didn't vote an advisory council in, they didn't vote you in.
      The ones they did vote in, like Juanita (which by the way, I am not Juanita) takes the time and effort to go around her ward and asks their opinion on issues. NEVER-NEVER-NEVER did the inept council do that - it always had to be their say only. That is why they were voted out.
      I see these people voting for the things their ward asks for, and that kind of government works, has for centuries. But with a mayor bent on vetoing everything that comes across her desk, and 3 puppets to back her up, you are at a stand-off.
      That's just the facts folks!

    6. Why is this blog so quiet? Will Jack, Lonny, & Watermelon Man with their noses up Juanita's "BIG BUTT" be at the Council meeting April 15th? Probably won't see The Ex-treasurer either. She is probably "Thumping Her BIBLE" somewhere else.
      Can't hardly wait until public COMMENT espically if the Bloggers on here are there to tell it like it is. (In their opinions) Hope there is alot of press coverage so the WHOLE State can see how our ALEXANDER CITY GOVERNMENT really looks and works.

      Stick in there MAYOR HOBBS. There are alot of City Citizens that appreciate what you are trying to do.
